Factual and Procedural Background

This Supreme Court record of proceedings concerns a group of connected matters led by a suo motu writ petition titled In re: Lack of Functional CCTVs in Police Stations (Suo Motu W.P.(C) No. 7 of 2025), heard on 29-01-2026. The Court noted, based on submissions of the learned Amicus Curiae, that the Union of India, the States of Chhattisgarh and Gujarat, and the Union Territory of Ladakh had not filed compliance affidavits in terms of the Court’s order dated 14-10-2025, despite a repeated opportunity granted by order dated 25-11-2025. The Court also took note of information that certain States (Kerala, Rajasthan, and Madhya Pradesh) had set up or were in the process of setting up centralized dashboards for monitoring CCTV infrastructure at district headquarters.

The proceedings also addressed a contempt petition (Contempt Petition (C) Diary No(s). 58490 of 2024), in which an application for withdrawal (I.A. No. 17837 of 2026) was filed and allowed.

Legal Issues Presented

The opinion addresses a procedural matter and does not frame distinct legal issues.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The Court proceeded on the basis of submissions made by the learned Amicus Curiae, including the continuing non-filing of required compliance affidavits by specified governments despite earlier opportunities. On a query from the Bench regarding the creation and functioning of centralized dashboards, the Court recorded the Amicus statement that some States had already established or were establishing such dashboards for monitoring CCTV infrastructure.

After hearing the Amicus Curiae and counsel for the Union of India, the States, and Union Territories, and upon a prima facie consideration, the Court concluded that the matter required “structured institutional deliberation at the highest administrative level.” Consequently, it directed a structured consultative process led by the learned Amicus Curiae with key executive stakeholders (Home Secretaries and Directors General of Police), to deliberate on feasibility, modalities, and implementation frameworks concerning issues flagged in earlier orders—specifically including a centralized dashboard, standardization of CCTV infrastructure, storage mechanisms, audit protocols, and independent oversight and technological interventions.

The Court also emphasized compliance enforcement by granting a “last and final opportunity” to the Union of India, Chhattisgarh, Gujarat, and Ladakh to file affidavits responding to queries raised in the 14-10-2025 order, warning that failing this, appropriate orders would be passed, particularly as an opportunity had already been provided on 25-11-2025.

Holding and Implications

DIRECTIONS ISSUED; CONTEMPT PETITION DISMISSED AS WITHDRAWN.

  • The learned Amicus Curiae was directed to hold virtual consultations with the Home Secretaries and Directors General of Police of all States and Union Territories on 21-02-2026; counsel for the Union of India and the States were permitted to join.
  • NALSA (through its Member Secretary) was directed to arrange the meeting at the specified NALSA office premises in the Supreme Court administrative complex, including technical facilities for virtual participation.
  • The learned Amicus Curiae was directed to submit a consolidated report reflecting consensus, divergences, practical difficulties, and suggestions from States/UTs; the report was to be placed on record by the next hearing to facilitate pan-India directions.
  • All States and Union Territories were directed to extend full cooperation to the learned Amicus Curiae.
  • The Union of India, Chhattisgarh, Gujarat, and Ladakh were granted a last and final opportunity to file affidavits responding to the Court’s queries (per orders dated 14-10-2025 and 25-11-2025), failing which appropriate orders were indicated.
  • The matters were directed to be listed on 26-02-2026 for receiving the learned Amicus Curiae report.
  • In Contempt Petition (C) Diary No(s). 58490 of 2024, withdrawal was allowed (I.A. No. 17837 of 2026), and the contempt petition was dismissed as withdrawn with liberty to file afresh if required.

The direct effect is to operationalize a coordinated, high-level consultative process aimed at informing future “pan-India directions” on CCTV monitoring and related governance mechanisms, while tightening compliance timelines for pending affidavits. The order does not articulate any new legal precedent; it primarily structures administrative deliberation and sets procedural steps and deadlines.

    1. We have heard the submissions advanced by Mr. Siddhartha Dave, learned Amicus Curiae. He has brought to the notice of this Court that, till date, the Union of India; the States of Chhattisgarh and Gujarat; and the Union Territory of Ladakh have not filed their compliance affidavits in terms of the orders dated 14th October, 2025, notwithstanding the repeated

    7

opportunity granted by this Court vide order dated 25th November, 2025.

    2. On a pertinent query made by this Court to the learned Amicus Curiae with regard to the creation and functioning of centralized dashboards in the States and Union Territories, he has apprised this Court that States such as Kerala, Rajasthan and Madhya Pradesh have already set up, or are in the process of setting up, centralized dashboards for monitoring CCTV infrastructure in the district headquarters.

    3. Having heard and considered the submissions advanced by Mr. Siddhartha Dave, learned Amicus Curiae, the learned counsel representing the Union of India as well as the respective States and the Union Territories and upon a prima facie consideration of the issues involved, we are of the view that the matter requires structured institutional deliberation at the highest administrative level.

    4. We, therefore, deem it appropriate to direct that the learned Amicus Curiae shall hold consultations and discussions with the Home Secretaries and the Director Generals of Police of all the States and Union Territories, through virtual mode on 21st February, 2026. The learned counsel for the Union of India and the respective States will be at liberty to join the meeting.

    5. The purpose of the aforesaid interaction shall be to deliberate upon the feasibility, modalities and implementation framework of the

    8

issues flagged in our earlier orders, particularly with regard to the creation of a centralized dashboard, standardization of CCTV infrastructure, storage mechanisms, audit protocols, and the role of independent oversight and technological interventions.

    6. The Member Secretary, National Legal Services Authority (NALSA), is directed to make all necessary arrangements for the aforesaid meeting to be held at the NALSA Office, B-Block, Ground Floor, Administrative Buildings Complex, Supreme Court of India, New Delhi, 110001, including providing the requisite infrastructure and technical facilities for virtual participation.

    7. The learned Amicus Curiae shall, after completing the aforesaid exercise, submit a consolidated report before this Court, indicating the broad consensus, divergences, practical difficulties, and concrete suggestions received from the States and Union Territories.

    8. The said report shall be placed on record by the next date of hearing, to facilitate the issuance of pan-India directions in the matter.

    9. All the States and Union Territories are directed to extend full cooperation to the learned Amicus Curiae for the effective conduct of the aforesaid deliberations.

    10. The Union of India as well as the States of Chhattisgarh and Gujarat and the Union Territory of Ladakh are granted a last and final opportunity to file an appropriate affidavit responding to the

    9

specific queries raised by this Court vide order dated 14th October, 2025, failing which appropriate orders shall be passed, particularly in view of the fact that an opportunity had already been granted by this Court for the very same purpose vide order dated 25th November, 2025.

    11. List the matter on 26th February, 2026 for receiving the report of the learned Amicus Curiae. Contempt Petition (C) Diary No(s). 58490 of 2024

    12. Learned counsel appearing for the petitioner has filed Interlocutory Application No. 17837 of 2026 seeking withdrawal of the contempt petition, which is allowed.

    13. The contempt petition is dismissed as withdrawn with liberty to file afresh, if so required.
