    ORDER

(Order of the Court was made by DR.ANITA SUMANTH, J.)

The prayer is for a mandamus directing the District Collector, the Tahsildar and the Block Development Officer, Dindigul District / R1, R2 & R3 to remove the encroachments on a cart track in S.Nos.162/1 and 163/1, Kuttathupatty Village, Dindigul West Taluk, Dindigul District. 2.When the matter had come up for admission on 19.09.2025, consciously we did not issue notice to R4 anticipating a survey to be conducted by the official respondents and report to the filed, verifying the allegations in the writ affidavit.

    3. Today, report is filed. Proceedings of the Tahsildar in V.P.No. 74/2025/F, dated 09.10.2025, are to the effect that there are two encroachments that have been found admeasuring 0.01.50 hectares in S.No.162/1 and 0.22.00 hectares in S.No.163/1.

    2/5

    4. Though the reports indicates that the encroachments are by Murugesan, it is unclear as to whether at all he participated in such survey or inspection. Thus, and having regard to the fact that we too have not issued notice to him, we are inclined to pass the following directions.

    (i) R2 / the Tahsildar, Dindigul West Taluk, Dindigul District shall issue notices under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 (Act), to the alleged encroacher calling for a response from him and proceed thereafter in terms of the provisions of the Act to secure possession of the land in question.

(ii) Let this exercise be carried out within a period of twelve

    (12) weeks from the date of receipt of a copy of this order.

    5. This writ petition is disposed in light of the above order. No costs.
