    Smt.Usha Devi v. State Of U.P.And 3 Others

    Court No. - 49 Case :- APPLICATION U/S 482 No. - 25490 of 2015 Applicant :- Smt.Usha Devi Opposite Party :- State Of U.P.And 3 Others Counsel for Applicant :- Sanjay Kumar Srivastava Counsel for Opposite Party :- Govt.Advocate Hon'ble Pankaj Naqvi,J.

Heard learned counsel for applicant and learned A.G.A.

The present application under Section 482 Cr.P.C. has been

filed for quashing the entire proceedings of Criminal Case

No. 512 of 2014, pending in the court of Civil

    Judge(J.D.)/Judicial Magistrate, Kasya, Kushi Nagar.

It is submitted that complaint filed by the applicant is pending

at the stage of Section 204 IPC, since June, 2014 and delay

in the issuance of the process is causing serious miscarriage

of justice and prejudice to the complainant. It is contended

that an appropriate direction be issued to the court

concerned to carry the complaint proceeding to its logical

    conclusion as expeditiously as possible.

Learned A.G.A has no objection in case this application is

disposed of by giving an appropriate direction to the court

    concerned.

This application is disposed of with the direction to the Civil

Judge (Jr.Division)/Judicial Magistrate, Kasya, Kushi Nagar

to take forward the Complaint Case no.512 of 2014 (Smt.

Usha Devi vs. Chintu & another) from the stage of Section

204 Cr.P.C to its logical conclusion as expeditiously as

possible. It is made clear that court below would not grant

unnecessary adjournments, adjournment if any, shall be for

strong and compelling reasons, else would attract exemplary

    cost.
