    Court No. - 36

Case :- CRIMINAL MISC. WRIT PETITION No. - 13135 of 2015

Petitioner :- Sushil Kumar Dubey And 3 Others Respondent :- State Of U.P. Thru Secy. And 2 Others Counsel for Petitioner :- I.K. Chaturvedi Counsel for Respondent :- Govt.Advocate,N.K. Mishra

    Hon'ble Rajes Kumar,J. Hon'ble Shamsher Bahadur Singh,J.

Heard learned counsel for the petitioners and the learned A.G.A. for the State.

The instant writ petition, under Article 226 of the Constitution of India, has been filed by the petitioners for quashing of the First Information Report, relating to Case Crime No. 680 of 2015, under Sections 419, 420, 467, 468, 471, 218 I.P.C., Police Station Kotwali Ghazipur, District Ghazipur.

The contention of the petitioner is that the allegation made in the FIR are absolutely wrong and baseless. The allegation is relating to some manipulation in record of revenue of year 1976 while the petitioners were not in service in those years.

We are of the view that matter requires investigation. No case for quashing of the First Information Report is made out.

However, in the facts and circumstances, we propose to stay the arrest of the petitioners till the submission of the police report under Section 173 Cr.P.C. in pursuance of the aforementioned case.

With the aforesaid observation, the writ petition stands disposed of.
