Ms. V. Soubharya Va-Ili, learned counsel represents Mr. V. Seetharama Avadhani, learned counsel for the applicants.
2. None appears on behalf of the respondent though served.
3. This application is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an arbitrator to resolve the disputes between the parties.
4. Facts giving rise to frling of this application briefly stated are that the parties have entered into Memorandum of Understanding dated O2.IL.2O2L. Clause 12 of the aforesaid Memorandum of Understanding contains an arbitration clause, which is extracted below for the facility of reference:

"ln case ofany dispute arise betrveenthe parties, have to settle amicabte in the event ofany failure to settle the dispute or difference shallbe referred to the arbitrator and the arbitreLtion proceedings will be conducted according tothe provisions of the Indian Arbitration and Concilizttion Act, 1996. The arbitration award willbe binding upon the both the parties and hnal' The place o[ the arbitration will be at Hyderabad and proceedings will be in English."
5. The applicants sent legal notice dated 22'05 2023to the respondent, but the respondent failed to respond tothe a-foresaid notice.
6. Dispute has arisen between the parties which requires resolution in the malner agreed to by the parties
7. A Bench of this Court by an order dated O2 O2'2O24 passed in Arbitration Application No'156 of 2023 between the same pa-rties has appointed Dr' Justice lihameem Akther, a former Judge of this Court as sole arbitratorto adjudicate the dispute between the parties'
8. Therefore, inthe _instant case also, Dr' Justice Shameem Akther, a former Judge of this Court (rr:sident of

Accordingly, the arbitration application is allowed. Miscellareous applications pending, if any, shall stald closed. No order as to costs.
