UPKAR RANA v. STATE OF HARYANA AND ORS

IN THE HIGH COURT OF PUNJAB AND HARYANA

    AT CHANDIGARH

CWP-18384-2024 Date of decision : 05.08.2024 Upkar Rana

    …….Petitioner

    Versus

State of Haryana and others ….Respondents

CORAM: HON'BLE MR. JUSTICE SHEEL NAGU, CHIEF JUSTICE HON'BLE MR. JUSTICE ANIL KSHETARPAL

    Present: Ms. Savita Rana, Advocate,

    for the petitioner.

Mr. Deepak Balyan, Addl. Advocate General, Haryana. ****

SHEEL NAGU, CHIEF JUSTICE ( Oral )

    1. This petition essentially challenges the decision of the respondents, in particular Annexure P-6, whereby 10% Economically Weaker Sections (EWS) quota for admission to various courses in Educational Institutions has been calculated with regard to vacancies pertaining to each category and not on the basis of total number of seats.

    2. Learned counsel for the petitioner has relied upon an interim order passed by this Court on 22.07.2024 in CWPs-15047-2024, whereby provisional admission in LL.M two years course starting from 01.08.2024 has been granted to the petitioner therein.

    1 of 2

    3. It is not disputed at the Bar that the said course has started from

    01.08.2024.

    4. More over, at this late juncture, if this Court entertains this petition, it would be opening of a pandora's box and violate various verdicts of the Apex Court in Medical Council of India Vs. Madhu Singh and others, (2002) 7 SCC 258 (para 23), Supreet Batra Vs. Union of India, (2003) 3 SCC 370 (para 7) and Dr. Astha Goel and others Vs. Medical Counselling Committee and others, 2022 SCC OnLine SC 734 (para 14) etc., laying down in categorical terms that in matters of admission to professional courses, the time lines prescribed for counseling and admission are to be strictly adhered to.

    5. In view of above, this Court declines to entertain this petition, for the petitioner having come late without any satisfactory explanation, and the course in question having commenced on 01.08.2024.

    6. Accordingly, the petition stands dismissed.
