Satendra Alias Bablu And 2 Others v. State of U.P. and Another

    Neutral Citation No. - 2024:AHC:106845

    Court No. - 74 Case :- APPLICATION U/S 482 No. - 6914 of 2024

Applicant :- Satendra Alias Bablu And 2 Others

Opposite Party :- State of U.P. and Another

Counsel for Applicant :- Manju Pandey

Counsel for Opposite Party :- G.A.

    Hon'ble Saurabh Shyam Shamshery,J.

    1. Heard Ms. Snehlata Mishra, Advocate holding brief of Ms. Manju Pandey, leaned counsel for applicants and Shri Mithilesh Kumar Dubey, learned A.G.A for State.

    2. Learned counsel for the applicant submits that the impugned order was passed under Section 204 Cr.P.C. whereby the applicants have been summoned to face trial under Sections 406 and 506 I.P.C., however, the same is bereft of the requisite reasons as well as that even considering the contents of the complaint and statements recorded under Sections 200 and 202 Cr.P.C., offence under Section 406 I.P.C. is not made out.

    3. Learned A.G.A has fairly supported the above submissions.

    4. The impugned order is as follows:

" - ददनननक 19.02.2020 पतनवलल पसतत हहई। दवदनन अधधवकन पररवनदल कक बहस तलबल पर सतनन गयन एवन उपलबध पपतत व बयनन अनतगरत धनरन 200 द०प०स० शलमतल पतषपन तथन अनतगरत धनरन 202 द०प०स० पदलप एवन रकहतनश व दसतनववजल पपतत कन अवलककन दकयन गयन।

    5. Considering the above submissions and taking note of the material before this Court, I find that there is merit in the argument of the learned counsel for the applicant that though the reasons are assigned but they are not supporting the ingredients of the offence under Sections 406 and 506 I.P.C., as there is no entrustment as there is no intent to harm, therefore, the order does not survive in the eyes of law.

    6. This application is being decided finally without even issuing notice to opposite party no. 2. therefore in the interest of justice the order is remitted back to learned trial court to pass a fresh order after taking note of judgement of Supreme Court passed in Lalankumar Singh and others Vs. State of Maharashtra, (2022) SCC OnLine SC 1383 as well as Mohammad Wajid and Anr. Vs. State of U.P. and Ors. 2023 INSC 683 and Kishore Biyani Vs. State of U.P. and Anr. 2024 AHC

    43655.

    7. Accordingly, the application is disposed of.
