Factual and Procedural Background

The petitioner, a Cable TV Operator, filed this writ petition in 2019 under Article 226 of the Constitution of India. The petitioner alleged that the 6th respondent was illegally transmitting signals through an Analogue system, which was prohibited after 2017 under the Cable Television Network Regulation Act, 1994. The petitioner sought a writ of mandamus directing the 1st and 2nd respondents to initiate action against the 6th respondent, seize the equipment used for the transmission of Analogue signals, and prosecute the 6th respondent under the said Act based on the petitioner's representation dated 01.11.2019. Notices were issued to the respondents, including the 6th respondent, who did not appear in court.

Legal Issues Presented

  1. Whether the 6th respondent is illegally transmitting Cable TV signals through an Analogue system in violation of Section 4A of the Cable Television Network Regulation Act, 1994.
  2. Whether the 1st and 2nd respondents are obligated to take action against the 6th respondent, including seizure of equipment and prosecution.

Arguments of the Parties

Petitioner’s Arguments

  • The 6th respondent is transmitting signals through an Analogue system, which is prohibited post-2017.
  • The petitioner requested the authorities to seize the equipment used for such transmission and prosecute the 6th respondent under the Cable Television Network Regulation Act, 1994.

Respondents’ Arguments

  • The respondents contended that no person is permitted to distribute signals through the Analogue system after 2017.
  • The petitioner failed to substantiate the claim that the 6th respondent was distributing signals exclusively through the Analogue system.

Table of Precedents Cited

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The court noted the petitioner’s allegation against the 6th respondent regarding transmission through an Analogue system, which is prohibited after 2017. However, the respondents pointed out that the petitioner did not provide sufficient evidence to prove that the 6th respondent was distributing signals solely through the Analogue system. The court also observed the absence of representation from the 6th respondent. Given the uncertainty about whether the 6th respondent continues to operate in the Cable TV field, the court declined to grant the relief sought. Instead, it advised the petitioner to file a complaint with the designated nodal officer if the alleged violation persists.

Holding and Implications

The court disposed of the writ petition without granting the requested mandamus. The petitioner was left at liberty to approach the Nodal Officer/District Revenue Officer for any further complaints regarding illegal transmission through the Analogue system. No costs were imposed, and the connected miscellaneous petition was closed. The decision does not establish any new precedent and directly affects only the parties involved by denying the petitioner's request for immediate intervention by the court.
