    Report of the Investigating Officer tendered by the

    learned APP is taken on record. Learned counsel Mr. MIG

    Mansuri is on leave. Considering the contents of the report, it

    reveals that the ‘C’ Summary report in terms of Section 173(8)

    of Cr.P.C. is filed by the I.O. and same is pending before the

    trial Court. It is reported that due to pendency of this

    application, the trial Court could not proceed further.

    Considering this aspect, without entering into the merits of the

    case, reserving the rights in favour of the applicant to raise all

    the contentions before the Court concerned, petition,

    accordingly, stands dismissed.

    Learned trial Court shall decide the ‘C’ Summary report

    in accordance with law on its own merits.
