Achhey Lal Chaurasia v. State Of U.P. And 2 Others

Court No. - 38 Case :- WRIT - A No. - 62 of 2020 Petitioner :- Achhey Lal Chaurasia Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Shravan Kumar Mishra Counsel for Respondent :- C.S.C.

    Hon'ble J.J. Munir,J.

Heard Sri Shravan Kumar Mishra, learned counsel for the petitioner and

Sri Sharad Chandra Upadhayay, learned State Law Officer appearing for

    the State.

The petitioner who is a Lekhpal has been suspended, pending inquiry. A

perusal of the impugned suspension order dated 15.10.2019 shows that

allegations against him are serious. The allegation is one of manipulation

in revenue record by showing for dead persons who were alive and on that

    basis effecting mutation.

The charges may be true or untrue but are serious enough to invite

imposition of a major penalty, if proved. The charges at inquiry may be

dispelled but that would not vitiate the order of suspension made for the

    present.

Accordingly, there is no good ground made out to interfere with the order

of suspension, which this Court refuses to quash. However, the pending

disciplinary proceedings against the petitioner shall be concluded within a

period of three months of the date of this order, of which the notice shall

be taken by the Disciplinary Authority and the Inquiry Officer, through Sri

Sharad Chandra Upadhayay, learned State Law Officer appearing for the

    State.

The petitioner shall cooperate with the inquiry and shall be paid his

    substances allowance regularly.

The writ petition is disposed of in terms of the aforesaid orders. There is

    no order as to costs.

Let a copy of this order be furnished to Sri Sharad Chandra Upadhayay,

learned State Law Officer for compliance.
