ORDER: (Per Hon'ble Sri Justice Abhinand Kumar Shavili) When the matter is taken up for hearing, learned counsel appearing for the respondent had informed this Court that the issue involved in this writ petition is squarely covered by the order dated 29-07-2013 passed by the Division Bench of this Court in W.P.No.2013 of 2012. Learned Government Pleader for Services-II appearing for the petitioners had contended the scheme of compassionate appointment in respect of medical invalidation grounds has been revived vide G.O.Ms.No.661, dated 23.10.2008, which shall be prospective in nature, but not in retrospective. Therefore, the Tribunal was not justified in allowing the O.A in favour of the respondent. Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that

the very same issue as to whether G.O.Ms.No.661, dated 23.10.2008 can be extended or not was considered by the Division Bench in W.P.No.2013 of 2012 and the Division Bench has dismissed the said writ petition vide order dated
29.07.2013.
Following the order dated 29-07-2013 passed in W.P.No.2013 of 2012 and for reasons alike, this Writ Petition is also dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
