    ORAL ORDER

    1. This is an application seeking cancellation of non-bailable warrant issued against the present petitioner. The applicant is arrested in relation to the First Information Report being C.R.No.I- 72 of 2014 registered with Mahuva police station for the offences punishable under sections 302, 291 and 120B of the Indian Penal Code. The Sessions Court has already examined 23 witnesses, out of the total witnesses of

    89. This Court had ordered day to day trial for about eight months. This Court has directed that in day to day trial, the petitioner has been granted the temporary bail and he had to surrender before the jail authority on 03.03.2019. According to him, on the issue of payment of residential house of Rs.7 lakhs, he could not manage the funds and, therefore, has not surrendered the non-bailable warrant issued against him on 12.04.2019. He is requesting for cancellation of non-bailable warrant.

    2. Mr. Majmudar, learned advocate for the applicant, has been heard. There is absolutely no question of this Court quashing the non-bailable warrant, the petitioner who was required to surrender before the jail authority on 03.03.2019, till date has not surrendered because of him the possibly the trial has hampered.

    3. The petition stands dismissed with cost of Rs. 10,000/-.
