Ram Narayan Jat v. State Of Rajasthan, Through Pp .

Sanjeev Prakash Sharma, J.:— Petitioner has filed this bail application under Section 439 Cr.P.C. in connection with FIR No. 407/2019 registered at Police Station Kalwar, District Jaipur for the offence under Section 302 IPC.

    2. Heard learned counsel for the accused-petitioner and learned Public Prosecutor appearing for the State as well as learned counsel for complainant and carefully scanned the relevant material made available on record.

    3. Learned counsel for accused-petitioner submits that the charge sheet has been filed. Both the accused and the deceased were friends and a sudden scuffle took place as is apparent from the statement which has come on record of eye-witnesses. During this scuffle, the deceased died. Learned counsel submits that case does not travel to Section 302 IPC and the trial is likely to take time. The petitioner is 61 years of age.

    4. Learned Public Prosecutor has opposed the bail application.

    5. I have considered the submissions and perused the challan papers and the post-mortem report, but without expressing any opinion on the merits and demerits of the case, I deem it appropriate to enlarge the accused-petitioner on bail.

    6. Therefore, this bail application is allowed and it is directed that accused-petitioner namely, Ram Narayan Jat S/o Shri Bhinva Ram shall be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR, provided he furnishes a personal bond in the sum of Rs. 50,000/- together with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
