    B.P. Colabalwalla, J.:— The present Sheriff's Report 26 of 2020 has been moved for seeking necessary directions to extend the date for sale of the defendant-vessel TAG 15 (IMO No. 9705550) upto 5 August, 2020 at 3:00 p.m. by publishing the Sheriff's notice in the newspapers in which the Sheriff's notice for auction has been published without changing other terms and conditions. In the alternative, directions are sought for conducting a re-auction of the said vessel by publishing a Sheriff's notice in the newspaper as per the Schedule annexed to the report.

    2. Having heard Mr. Kamat, the learned counsel appearing on behalf of the plaintiff and the Sheriff who is present in Court before me today, as well as perusing the Sheriff's report, it is directed as follows:

    (a) The time to submit the bids for sale of the defendant-vessel is extended upto 5 August, 2020 and if any bids are received, the same shall be opened on 6 August 2020 at 3:00 p.m. For the purposes of this extension, the Sheriff shall publish a notice forthwith in the newspaper in which the Sheriff's notice for auction was published earlier, without changing any other terms and conditions. The cost of this advertisement shall be borne by the plaintiff in the first instance.

    (b) If, for any reason, no bids are received by 5 August, 2020, the Sheriff shall conduct re-auction of the defendant-vessel by publishing the Sheriff's notice in the newspapers as per the Schedule set out herein:

    TAG 15 (IMO NO. 9705550)

    1) Meeting to settle the auction sale of the Defendant-vessel On 13th August 2020 at 11:30 a.m. 2) Publication of advertisement in “Free Press Journal”. “Nav Shakti” in Mumbai 17th August, 2020 3) Inspection to be given to the intending bidders for inspection of the veessel 17th August, 2020 to 25th August, 2020 4) Submission of offers with EMD of Rs. 50,00,000/- On or before 27th August, 2020 upto 4:30 p.m. 5) Opening of bids before this Hon'ble Court On 31st August, 2020 at 3:00 p.m.

    3. The expenses for the re-auction, if any, shall be borne in the first instance by the plaintiff and shall be treated as Sheriff's expenses/liquidation expenses.

    4. The Sheriff's Report is, accordingly, disposed of.
