Factual and Procedural Background

The applicant, Umesh Singh, challenged the disciplinary penalty imposed on him by the Disciplinary Authority through an order dated 09.02.2017, which was confirmed by the Appellate Authority on 12/13.07.2017. The penalty entailed reduction by one stage in the time scale of pay for one year, with no increments earned during this period, and a postponement of future increments after the period of reduction. The applicant's review application against this penalty was rejected by the authorities. The applicant contended that other officials facing identical charges and working in the same department had their penalties modified by the reviewing authority on 28.12.2019 to a lesser form, where the reduction did not postpone future increments. Consequently, the applicant sought a similar modification of his penalty. The Tribunal heard this OA along with OA Nos.182 and 184 of 2018 due to the similarity of subject matter.

Legal Issues Presented

  1. Whether the penalty imposed on the applicant should be modified to ensure parity with other similarly situated officials who had their penalties reduced by the reviewing authority.
  2. Whether the applicant is entitled to a modification of the penalty such that the reduction in pay scale does not postpone future increments.

Arguments of the Parties

Applicant's Arguments

  • The penalty imposed on the applicant is harsher compared to those awarded to other officials facing identical charges in the same department.
  • The applicant seeks parity by requesting that his penalty be modified in line with the reviewing authority’s order dated 28.12.2019, which limited the effect of reduction in pay scale without postponing future increments.

Respondents' Arguments

  • The respondents argued that the applicant’s request essentially amounts to a claim for parity in punishment.

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The Tribunal noted that the charges against the applicant were similar in nature to those against other officials whose penalties had been modified by the reviewing authority. Given the identical nature of charges and the passage of time since the filing of the OA in 2018, the Tribunal found it appropriate to apply the principle of parity and natural justice. It concluded that the penalty imposed on the applicant should be modified in accordance with the reviewing authority’s order dated 28.12.2019, which entailed reduction by one stage in the time scale of pay for one year, with no increments earned during that period, but without postponing future increments. The Tribunal directed the reviewing authority to implement this modification within two months of receiving the order.

Holding and Implications

The OA No.184/2018 is disposed of with a direction to modify the penalty imposed on the applicant in line with the reviewing authority’s order dated 28.12.2019.

The direct effect of this decision is that the applicant’s penalty will be softened by removing the postponement of future increments, ensuring parity with similarly situated officials. No new precedent was set beyond the application of the principle of parity and natural justice.

    7. On the otherhand, Shri Joy Mathew counsel for the respondents submits that as such, the request of the applicant is tantamount to claiming parity with regard to punishment awarded to him by the Disciplinary Authority.

    8. Heard the parties and perused the material on record, as also order passed by the reviewing authority dated 28.12.2019 in case of aforesaid two other charged officials. Prima facie, it appears that charges levelled against the applicant and the officials as referred in the order passed by the reviewing authority are similar in nature, we noticed that the OA was filed in the year 2018 and undisputedly, charges levelled against the applicant are similar in nature and hence we are of the considered opinion that the penalty order deserves to be modified in terms of order dated 28.12.2019 passed by the reviewing authority in the case of aforesaid two charged officials. In terms of natural justice, the applicant is entitled for reduction by
