1. We have heard learned counsel for the petitioner and learned counsel for respondent No. 3. Learned counsel for respondent No. 2, however, seeks time to take instructions.
2. Learned counsel for respondent No. 2 also makes a statement that the impugned notice for auction of the property fails since the Earnest Money Deposit is not received. The statement is accepted.
3. In the above circumstances, we defer hearing of the petition till 11 November, 2019.
4. In the meantime, respondent No. 2 shall consider respondent No. 3's representation for settlement of dues.
