    Rmp Infotec Pvt. Ltd. v. State Of Kerala

    Alexander Thomas, J.:— The prayer in the above Criminal Miscellaneous Case filed under Section 482 of the Cr.P.C. is as follows:

    “….. to quash the proceedings in C.C. No. 427/2019 pending before the Chief Judicial Magistrate's Court, Kottayam and render justice to the petitioners.”

    2. The counsel for the petitioners submits that this Court has already passed final order dated 18.09.2020 in the connected Crl.M.C No. 266 of 2020 in which the very same petitioners/accused herein are the petitioners/accused therein in respect of the similar offence arising out the similar transaction and this Court has quashed the impugned criminal proceedings in that case on the ground of settlement between the parties. Further that in this case as well the petitioners have taken serious steps to get the matter settled with the parties and it is expected that the settlement process will be finalized in all respect within about a month also and further that this Court may close this petition with liberty to the petitioners to approach this Court again at appropriate time etc. The liberty is accorded to the petitioners to work out their remedies in the manner in law.

    3. The Registry may return back the certified copy of Annexure I final report to the petitioners' counsel, if a request is made in that regard. However, the Registry will ensure that photocopies of the said document are placed in the original case file for the purpose of maintaining records. All issues are left open. Further proceedings in the instant impugned Annexure - I Calendar Case CC No. 427 of 2019 on the file of the Chief Judicial Magistrate's Court, Kottayam shall stand deferred for a period of three months to enable the petitioners to attempt for settlement.

    4. With these observations and directions with the said liberty, the above Criminal Miscellaneous Case will stand disposed of.
