1. In this execution application we have been informed by Learned Counsels for the parties that part of the encroachment on the site in question has been removed. For the remaining part NOIDA Authority has sought police assistance but the District Magistrate showed his inability. This is rather surprising that in a matter of removal of encroachment, the District Magistrate does not take steps at the relevant time or subsequent to it to ensure that this illegal occupant should be removed.
2. In view of the above, we direct the District Magistrate, Gautam Budh Nagar to provide adequate police assistance or any other help required by the NODIA Authority for removal of the encroachments completely. In case need arises the District Magistrate may approach the higher authorities and get adequate force immediately and ensure that encroachments are removed before the next date of hearing. The NODIA Authority has also to take appropriate steps for doing the needful before the force is sent by the District Magistrate.
3. It shall be the duty of the District Magistrate to coordinate with the NOIDA Authority and get the required force for the purpose of removal the encroachment. Thereafter the District Magistrate shall ensure that the same is provided on the date and time informed by the NOIDA Authority.
4. In case the encroachments are not fully removed, the District Magistrate, Gautam Budh Nagar, shall remain present before the Tribunal.
