2. The petitioner has challenged the order dated 19 June, 2018 issuing order of proclamation and non-bailable warrant by the learned Metropolitan Magistrate, 48 Court, Andheri, Mumbai in CC/734/2016. The petitioner is facing prosecution under Section 138 of Negotiable Instrument Acts. It is submitted that next date before the trial Court is 31 August, 2018. Learned counsel for the petitioner on instruction submits that the petitioner undertakes to remain present before the trial Court on the next date of hearing i.e 31 August, 2018 and would make requisite application for setting aside the order of proclamation and cancellation of non-bailable warrant.
3. Issue notice to Respondent No. 1, returnable on 3 September, 2018.
4. The petitioner shall appear before the trial Court on 31 August, 2018 and shall prefer requisite application for setting aside the order of proclamation and cancellation of non-bailable warrant. In case, such application is preferred by the petitioner before the trial Court, the said Court shall decide it in accordance with law.
5. In the meantime, till the next date of hearing the execution of impugned orders passed by trial Court are stayed.
6. Leave to amend to annex the order issuing non-bailable warrant. Amendment to be carried out within one week.
7. Parties to act upon the authenticated copy of this order.
8. Stand over to 3 September, 2018.
