In pursuance of the direction given by this Tribunal on 11.12.2012, the learned counsel for respondents has submitted that the petitioner has been brought before a Medical Board on 11.03.2013 at Base Hospital, Delhi Cantt. and his disability has been assessed as 30% for life. Since he has already been assessed at 30% disability due to Military Service, therefore, the petitioner is entitled to disability pension from the date of retirement on 31.03.2011. The petition is allowed accordingly. All the arrears should be worked out alongwith 12% interest and same shall be paid to the petitioner as far as possible within a period of three months. The petition is allowed. No order as to costs.
