1. This is an OA, under Section 14 of the Armed Forces Tribunal Act, 2007, seeking direction to consider the petitioner's case as a special review for promotion to the rank of Colonel against the vacancy of Director, Signal-3 that had occurred on 31.12.2015.
2. Learned Sr. CGSC submits that he has instructions to say that the petitioner's case for the promotion shall be considered by the Selection Board 3 to be held in the month of March, 2016, despite the fact that he is going to be superannuated w.e.f. 29.02.2016.
3. In such a situation, nothing survives in the OA.
4. The OA, accordingly, stands disposed of with liberty to the petitioner to challenge any adverse consequence, in accordance, with law.
