September 14, 2018 High Court at Calcutta Revisional Jurisdiction C.O. 3167 of 2018 Sri Arindam Haldar Versus Smt. Bidusi Haldar nee Sardar Mr. Debjit Mukherjee, Ms. Dipanwita Ganguly, for the petitioner.
The grievance of the husband/petitioner is that a divorce suit filed by him has been kept pending inordinately for a long time, despite the same being at the peremptory hearing stage. It is specifically averred in paragraph 17 of this application under Article 227 of the Constitution of India that no application for alimony pendente lite under Section 24 of the Hindu Marriage Act was filed by the wife in the said suit.
As such, in view of the nature of the order proposed to be passed, no prior service of notice of this revisional application on the opposite party is deemed necessary.
C.O. 3167 of 2018 is disposed of by requesting the Additional District Judge, Thirteenth Court at Alipore, South 24-Paraganas, to dispose of Matrimonial Suit No. 47 of 2014, pending in the said court, as expeditiously as possible, preferably within March 31, 2019, without granting any unnecessary adjournment to either of the parties.
There will be no order as to costs.
The petitioner shall communicate this order to the court below as well as to the opposite party and/or her learned advocate appearing in the court below at the earliest.
