    In The Matter v. M/S. N & N Industries

    1. Mr. Mr. Nikhil Nayyar takes Notice on behalf of Respondents nos. 2 and 3.

    2. Respondents Nos. 1 and 4 are not represented. Tracking report produced by the Applicant shows Respondent No. 1 is served but not Respondent No. 4. We permit fresh Notice to Respondent no. 4 and we direct Respondent nos. 1 to 3 to file their Replies within ten days from now. Applicant's counsel seeks interim order to stay operation to the impugned directions issued by the Pollution Control Board. However, learned counsel for Pollution Control Board submits that he would take Notice and requires reasonable time to obtain instruction. Though, urgency is highlighted by the learned counsel for the Applicant we are also of the opinion that the Board must be reasonable in passing order hence we grant 10 days time to file response particularly to the Pollution Control Board to the interim relief as well as main relief sought by the Applicant after serving copies to the Applicant who may file Rejoinder within one week thereafter.

    3. List this matter for consideration on interim relief on 18th May, 2018.

    4. In the meanwhile, there shall be interim order of stay to the direction issued by the Telangana Pollution Control Board subject to further orders that may be passed at the same time we direct the Industry to take all required steps as may be necessary for compliance subject to further order that may be passed in Original Application No. 723 of 2018.

    5. This order shall not apply to other areas and other Pollution Control Boards because the order impugned was passed in this case by Telangana State Pollution Control Board. This order shall also be subject to the order passed in Original Application No. 723 of 2017 that is pending consideration request for grant of interim order.

    6. No coercive action will be taken against the applicant industry till the next date of hearing.
