This writ appeal filed u/S. 2(1) of M.P Uchcha Nyayalaya (Khand Nyayapeeth Ko Appeal) Adhiniyam 2005 assails the final order dated 18.03.2008 passed in Writ Petition No. 1513/2003(S) whereby the appeal of the appellant/petitioner has been dismissed by holding that the appellant/petitioner has no legal right for appointment on the post of LDC for having failed to fulfill the mandatory requirement of the contractual appointment of passing the typing test within the prescribed period.
The writ court while dismissing the petition has found that the appellant/petitioner admittedly failed to pass the typing test before 31.12.1998 till when the contractual appointment of the appellant/petitioner was continued.
One of the mandatory terms of the contractual appointment obliged the appellant/petitioner to pass the typing test which he failed to do before 31.12.1998
Though it is submitted by the counsel for the appellant/petitioner that the appellant/petitioner has passed typing test on 24.10.2002 but the same fact is of no avail to the appellant/petitioner as the contractual appointment had already come to an end way back on 31.12.1998
This court, thus, does not find any illegality or impropriety in the order of the learned Single Judge and therefore upholds the same. The writ appeal is therefore rejected without any order as to cost.
