The petitioner has preferred this writ petition mainly for the following relief:
“(B)- to issue a writ order or direction in the nature of Mandamus commanding the respondents to directing permit the petitioner to appear in the group discussion test for the post of Sub Inspector in U.P Police which is already continue till 11.01.2015”
The grievance of the petitioner is that she had applied for the post of Sub-Inspector and Platoon Commander pursuant to an advertisement published by the Uttar Pradesh Police Recruitment and Promotion Board, Lucknow. She has cleared the physical test and the written examination. She was called for the Group Discussion, which was scheduled to be held on 22nd December 2014 between 10.45 A.M to 11.45 A.M But due to the dense fog the train arrived at Lucknow on 22 December 2014 at 1.35 P.M and for the said reason, the petitioner could not attend the Group Discussion. She has moved an application on the same date i.e 22 December, 2014 before the respondent no. 2 for allowing her to appear in the Group Discussion on some other date as due to unavoidable circumstances she could not reach at the center within time.
Heard the petitioner in-person and learned Standing Counsel, who has accepted notices on behalf of both the respondents.
From the perusal of the record it appears that though the petitioner is a resident of District Baghpat, but the office of the respondent no. 2 is at Lucknow.
Matter needs consideration.
Learned Standing Counsel prays for and is granted four weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.
List thereafter.
Considering the peculiar facts and circumstances of the case that the petitioner is a lady and she has filed the writ petition at Allahabad on the legal advice, as an interim measure the respondent no. 2.appropriate authority is directed to permit the petitioner to appear in the Group Discussion. However, her result shall abide by the result of the writ petition. Any objection with regard to territorial jurisdiction of this Court is left open to be considered at the time of hearing.
The certified copy of this order shall be supplied to the petitioner on payment of usual charges today.
