Smart Summary

Factual and Procedural Background

The respondent No. 3, Saiyed Irfan Riyazul Hussain @ Akbarali Riyazul Hussain, produced a certificate of marriage issued by the Marriage Officer for Ahmedabad under Section 13 of the Special Marriage Act. The certificate listed three witnesses and was registered under Sr. No. 271/2014. The marriage register and notice of intended marriage showed that both respondent No. 3 and respondent No. 2, Damini Babubhai Chavada, declared themselves unmarried at the time of the intended marriage. However, it was found that incorrect information was declared before the Marriage Officer. The Court was called upon to examine the validity of the marriage solemnized under the Special Marriage Act based on these declarations and related facts. The Court also addressed protective measures for respondent No. 2, who was reportedly under the influence of respondent No. 3.

Legal Issues Presented

  1. Whether the marriage solemnized under the Special Marriage Act is valid when the parties have made incorrect declarations regarding their marital status.
  2. Whether the conditions under Section 4 of the Special Marriage Act, 1954, specifically the condition that neither party has a living spouse, have been fulfilled.
  3. The appropriate protective measures for respondent No. 2, given the circumstances of influence and threats to her safety.

Arguments of the Parties

Learned Advocate Mr. Apurva Dave's Arguments

  • Invited the Court's attention to Section 4 of the Special Marriage Act, 1954, which sets out conditions for solemnization of marriage.
  • Contended that the marriage claimed to have been solemnized is contrary to the specific condition that neither party should have a living spouse, making the marriage prima facie invalid.

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The Court examined the certificate of marriage, the marriage register, and the declarations made by the parties under the Special Marriage Act. It found that the declarations made by respondent Nos. 2 and 3 were incorrect, specifically regarding their marital status. Referring to Section 4 of the Special Marriage Act, which requires that neither party have a living spouse at the time of solemnization, the Court concluded that the marriage was prima facie invalid. Considering respondent No. 2 was under the influence of respondent No. 3, the Court directed protective custody for her at a Nari Sarakshan Gruh/Nari Vikas Gruh until the next hearing. The Court also directed the police to present the matter to the Marriage Officer for further action on the false declaration. Protective measures were emphasized following an incident where respondent No. 2 threatened self-harm.

Holding and Implications

The Court held that the marriage solemnized under the Special Marriage Act is prima facie invalid due to incorrect declarations regarding marital status, which is a condition precedent under Section 4 of the Act.

The Court ordered respondent No. 2 to be placed in protective custody to safeguard her from undue influence and potential harm. It also directed the police to ensure appropriate action is taken against the false declaration made before the Marriage Officer. The decision directly affects the validity of the marriage between the parties and the immediate safety of respondent No. 2. No broader legal precedent was established beyond the facts of this case.
