Prem Chand Singh Roy And Others v. Dharmadas Singh Roy Opposite Party.

    1. A rule was granted in this case to show cause why the order, dated 2nd November, directing the prosecution of the Petitioners under sec. 188, I.P.C, should not be set aside. The intended prosecution was for disobedience to an order, dated 22nd September last, which amongst other, things directed that the Petitioners should refrain from collecting rents from any tenants on certain lands. That order which purported to have been made under see. 144, C. Cr. P., was not an order which could properly be made under the section. The order therefore directing the prosecution of the Petitioners for disobedience to that order cannot stand.

    2. We therefore set it aside and make the rule absolute.

    3. Rule made absolute.
