Ram Chandra v. State Of Raj. & Ors.(18)

M.R Calla, J.:— This writ petition was filed in the year 1982. During the pendency of this writ petition a letter was sent to the Director, Agriculture by the Assistant Secretary on 14th May, 1986, stating therein that an affidavit had been taken from the petitioner that in case the salary is paid to the petitioner for the period from 1st May, 1980 to 2nd October, 1981, he would withdraw the writ petition. A copy of this letter was also sent to the petitioner. The petitioner accordingly gave an affidavit dated 17th May, 1986, stating that in case the salary is paid to him for the period from 1st May, 1980 to 2nd Oct., 1981, he would withdraw the writ petition. Thereafter the Special Secretary to the Government, Agriculture Department (Gr. I), Jaipur sent a letter on 13th October, 1986, to the Director Agriculture and a further letter dated 17th July, 1987 to the Director Agriculture as D.O letter impressing upon the Director Agriculture to make payment of the salary to the petitioner for the period from 1st May, 1980 to 2nd October, 1981. The grievance of the petitioner is that despite these letters sent to the Director, Agriculture Department, Government of Rajasthan by the Special Secretary to the Government Agriculture Department (Gr. I), Jaipur, the Director Agriculture is not making the payment to the petitioner for the period in question.

    2. In these circumstances, it is directed that the respondents would make the payment of salary for the period from 1st May, 1980 to 2nd October, 1981 to the petitioner within a period of two months from the date the copy of this order is made available to the concerned authorities.

    3. The petitioner shall also be entitled to all consequential benefits as a result of the payment of the salary for this period i.e 1st May, 1980 to 2nd October, 1981.

    4. The writ petition is, therefore, decided as indicated above and the same stands disposed of accordingly.
