Mr. Santosh Kumar Deepak, learned counsel appears on behalf of the respondents and submits that he would be filing his Vakalatnama within a week. He also submits that as per instruction he wishes to hand over a cheque of Rs. 2.50 Lakhs as against settlement amount of Rs. 9 Lakhs. He further submits that the respondent will pay the total amount in the first week of April. Mr. Shashank Sekhar, learned counsel appearing on behalf of the petitioner, however, is reluctant to accept the cheque and submits that earlier also three PDCs were handed over by the respondent but all of them were not honoured by the bank for payment. He draws our attention to an order of the Tribunal dated 3.6.2017 whereby the Tribunal had taken cognizance and issued notice to the respondents to show cause why proceedings under Section 20 of the TRAI Act may not be initiated against it. It is seen that the respondents have not filed the reply to the notice either. It is also seen that the respondent in spite of clear direction is absent today. Put up under the same head on 11.4.2017 when the respondents will file show cause to the notice that why proceedings under Section 20 of the TRAI Act may not be initiated as also for non-appearance in spite of clear direction today. In the meanwhile, as submitted by learned counsel for the respondent, the outstanding against of Rs. 9 Lakhs shall be cleared thorough effective payment by the next date.
