The audit by BECIL is under process and we were informed by Mr. Rajeev Sharma, counsel for BECIL that the report is likely to be submitted by 20.8.2015.
Mr. Tandon, counsel for the respondent submits that the petitioner is receiving the respondent's signals continuously, it has not made any payments since 31.3.2015. According to Mr. Tandon, the respondent's dues against the petitioner, as on date, amount to Rs. 2.44 crores (approx.).
Mr. Mehta, counsel for the petitioner submits that if the amount of carriage fee payable to the petitioner is taken into account, the amount of dues will be much lower.
Without going into any further controversy and without ascertaining, at this stage, the exact amount due against the petitioner, we direct it to make an on account payment of Rs. 1 crore to the respondent. In case the payment is not made by 15.8.2015, it will be open to the respondent to discontinue the supply of its signals to the petitioner.
It is, however, made clear that the payment as directed above, is purely an interim arrangement and is without prejudice to the rights and contentions of the parties and shall abide by the final order passed in this case.
Put up under the same heading on 24.8.2015.
