In pursuance of the last Order dated 11.10.2012, out of these 11 appeals (Item Nos. 1 to 11), 7 appellants have filed amendment applications. If the copies are not served on the other side, the same shall be served. 4 of the appellants (Item Nos. 2, 3, 4 and 8) have chosen not to file any amended memo of appeal. The learned counsels appearing for them make a statement that they do not want to make any amended memo of appeal. The learned counsel appearing for the CCI has no objection, if the amendments are allowed. Accordingly, the amendments are allowed in Appeal Nos. 105, 104, 106, 107, 111, 112 and 113 of 2012. It is reported that the amended memo of appeals in some of the matters are not filed. The same be filed immediately within one week from today. The copy of the amended appeal shall also be given to the CCI as well as to the other respondent, i.e Builders Association of India.
In these 11 appeals, according to the learned counsel appearing on behalf of the appellants, there are some issues which are common to all the appeals. They suggest that those issues may be argued first and thereafter, the appeal should be individually heard on the questions which are pertaining to that particular appeal. The suggestion is accepted by the learned counsel on behalf of the CCI. The learned counsels for the appellants agree that they will formulate common questions and circulate amongst themselves as well as to the counsels for the other side, i.e the counsel for the CCI as well as the counsel for Builders Association of India.
The matter shall be heard on 29 January, 2013. The interim protection shall continue till then.
