    DEVENDRA@SINTU v. SMT LALITA

Mr. C.S. Meena for the petitioner.

Mr. Yogesh Singhal for the respondent.

This revision petition has been filed against the order dated 17.06.2014 whereby the learned court below has allowed the application filed by the respondent under section 125 Cr.P.C.

and awarded maintenance of Rs.1,500/- per month.

It is also to be noted that after filing of the application under section 125 Cr.P.C., counsel for the petitioner appeared and sought time for filing reply. However, no one appeared on the next date i.e. 12.12.2011 and an exparte order was drawn. On filing of the application for setting aside the exparte order on 20.04.2012, the learned court below had set aside the exparte order on 27.08.2012 on the cost of Rs.500/-. The petitioner had neither deposited the said cost nor appeared before the court below.

Consequently, again an exparte order was drawn against the petitioner on 03.12.2013.

After carefully going through the order passed by the learned court below for granting of maintenance to the respondent and having considered the conduct of the petitioner before the learned court below for repeatedly not appearing before it, there is no just reason for this court to interfere in the order passed by the learned Judge, Family Court, Bharatpur, while exercising its revisional jurisdiction.

Consequently, this revision petition is dismissed.
