HON'BLE MR. JUSTICE JK RANKA Order 05/05/2017 Matter has come up on misc. application for recalling of order dt.4.2.2016.
When the original petition came to be filed by the applicant Captain Gurvinder Singh DBCWP No.1862/2013, petitioner challenged the validity of the Rajasthan Scheduled Castes, Scheduled Tribes, Backward Classes, Special Backward Classes and Economically Backward Classes (Reservation of Seats in Educational Institutions in the State and of Appointments and Posts in Services under the State) Act, 2008 (Act 2008) and so also the consequential prayers of which reference has been made in para 5 of the present application.
Pending writ petition, in supercession of the Act 2008, the Rajasthan Special Backward Classes (Reservation of Seats in Educational Institutions in the State and of Appointments was examined and Posts in Services under the State) Act, 2015 (Act 2015) was enacted and made effective in exercise of power under sub-sec.(3) of Sec.1 of the Act 2015 vide notification dt.16.10.2015 and after the matter being heard, this Court keeping in view the effect of Sec.9 (Repeal & Saving) disposed the writ petition to be infructuous vide order dt.4.2.2016.
(3 of 4) [WMAP-79/2016] Immediately thereafter the present application came to be filed pointing out that apart from the validity of the Act 2008 there are other certain reliefs have been prayed for by the petitioner may be examined even after the Act of 2015 has come into force.
This fact can be noticed that the Act 2015 came to be separately challenged by the present applicant in DBCWP No.1645/2016 and has been decided by this court vide judgment dt.9.12.2016 & operative part whereof reads ad infra- In view of the discussion made above, the report of the SBC Commission cannot be accepted and is, accordingly, quashed. As a consequence of the aforesaid apart from the discussion made in reference to Article 16(4B) of the Constitution of India and the judgments of the Apex Court, the impugned Notification dated 16th October, 2015 issued by the State Government and the Rajasthan Special Backward Classes (Reservation of Seats in Educational Institutions in the State and of Appointments and Posts in Services under the State) Act, 2015 are struck down.
Counsel for the applicant submits that even after change of circumstances and apart from the validity of the Act 2008 there are other relief prayed for by the petitioner and that deserve indulgence of this court to be examined on merits.
When we look into other ancillary prayer made for by the applicant in the writ petition that is in regard to questioning the recommendations made either by the Commission or by the Institute of Development Studies which could not be challenged by the petitioner in the independent proceedings.
After we have heard counsel for the applicant and taking (4 of 4) [WMAP-79/2016] note of the submissions made, in our considered view, the prayers on which much emphasis has been led by the applicants counsel are the material/inputs for the State govt./concerned authority in taking its decision while enacting legislation on the subject and based on the material, the Act 2015 has been examined by this court of which we have made a reference in detail.
In our considered view, what is being prayed for in view of subsequent event noticed by us the misc. application has no substance and is accordingly dismissed but still as a caution, we leave it open to be challenged in the independent proceedings, if so advised.
