Factual and Procedural Background

The impugned order of the National Consumer Disputes Redressal Commission, New Delhi directed Respondents 1 to 4 to refund admission expenses paid by the complainants at the time of admission, with interest at 12% per annum from the date of receipt of the amount until the date of payment. The Commission also awarded Rs 20,000 to each complainant as compensation for expenses on books, mess, hostel for two years, and for the loss of two academic years.

Upon admission of the appeal on 23-2-2001, this Court granted an interim stay of the impugned judgment/order, conditional on the appellant depositing the sums directed by the Commission with the National Commission within four weeks.

It is recorded that neither the interest nor the Rs 20,000 per complainant had been deposited or paid despite the Commission’s order and the condition attached to the interim stay. The complainants asserted that the appellant was in breach of this Court’s order. During the present hearing, counsel for the appellant undertook to deposit the interest and Rs 20,000 per complainant before the National Commission within one week. Based on this undertaking, the Court refrained from taking action against the appellants and directed that the specified amounts be deposited within one week, clarifying that interest is payable from the date of receipt of the amount until the date of payment. The matter was listed to be heard further on 3-12-2008, with written submissions permitted by 1-12-2008.

Court's Reasoning and Analysis

The Court’s determination is grounded in the appellant’s undertaking to promptly comply with the financial components of the Commission’s order. In view of this express commitment, the Court chose not to initiate any action against the appellants. The Court reinforced compliance by:

  • Directing that the due amounts be deposited within one week before the National Commission.
  • Clarifying the computation of interest as running from the date of receipt of the amount until the date of actual payment, consistent with the Commission’s directive.
  • Maintaining the appellate process by listing the matter as part-heard on a specified date and allowing written submissions by a set deadline.

Overall, the Court’s approach prioritizes immediate compliance with the monetary aspects of the impugned order while preserving the pending appeal for further adjudication.

Holding and Implications

HOLDING: The Court accepted the appellant’s undertaking and directed deposit of the interest and Rs 20,000 per complainant before the National Commission within one week; clarified that interest is payable from the date of receipt to the date of payment; refrained from taking action against the appellants; and listed the matter for further hearing on 3-12-2008, permitting written submissions by 1-12-2008.

IMPLICATIONS: The appellants must immediately comply by depositing the ordered sums with the National Commission. The complainants gain the prospect of prompt receipt of the amounts upon deposit. The appeal remains pending and will proceed as a part-heard matter on the scheduled date. No broader legal principle or new precedent is established by this procedural order.

    Order

    1. The National Consumer Disputes Redressal Commission, New Delhi in the impugned order, directed Respondents 1 to 4 to refund the admission expenses paid by the complainants at the time of admission with interest calculated at the rate of 12% p.a from the date of receipt of the amount till date of payment and also Rs 20,000 to each of the complainants by way of compensation for the expenses defrayed on purchase of books, mess expenses, hostel expenses for two years and for the loss of two valuable academic years. This Court while admitting appeal on 23-2-2001 directed that there shall be interim stay of the operation of the judgment/order under challenge subject to the condition that the appellant deposits the sum as directed therein with the National Commission within four weeks.

    2. It is not disputed by the learned counsel appearing for the appellant that neither the interest nor the payment of Rs 20,000 each has been deposited or paid to the complainants despite clear orders of the Commission. According to the complainants, the appellant is clearly in breach of the order of this Court.

    3. Learned counsel appearing for the appellant fairly submitted that the interest amount and the payment of Rs 20,000 each to the complainants by way of compensation would be deposited before the National Commission within one week from today.

    4. In view of this undertaking, we are not taking any action against the appellants (who were Respondents 1 to 4 before the National Commission). Let this amount be deposited within one week from today before the National Commission. It is made clear that the interest amount would be paid from the date of receipt of the amount till the date of payment (as directed by the Commission).

    5. List this matter again on 3-12-2008 as part-heard. Parties are permitted to file written submissions by Monday i.e 1-12-2008.
