Sukhdev Singh Petitioner v. State Of Punjab And Others S

    TEJINDER SINGH DHINDSA, J.

Petitioner who was serving on the post of Senior Assistant under the Department of Labour and Employment, State of Punjab has filed the instant writ petition praying that issuance of the writ of mandamus for directing the respondents to grant to him the benefit of extension in service for a period of one year in view of the option letter dated 09.07.2013 (Annexure P-1) that had been submitted by him.

Counsel for the petitioner has been heard. The State Government Finance Department issued Circular dated 08.10.2012 (Annexure P-2) on the subject of extension of one year of service of employees of the Punjab Government. In the circular, sanction had been granted by the State Government in the light of Rule 3.26 Clause (a) and Clause (b) of the Punjab Civil Services Rules, Volume-I, Part-I for extension in service by one year to Group A, B, C and D employees on completion of 58 years (Group A, B and C) and 60 years (Group D employees)

During the course of hearing, Mr. Chander Shekhar, learned counsel for the petitioner would very fairly concede that the petitioner being a handicapped employee has already enjoyed an extension in service for a period of two years beyond the normal age of superannuation of Group ‘C’ employee i.e 58 years. Concededly, the extension in service as prayed in the present writ petition is beyond the age of 60 years. Such claim is not admissible under the Circular dated 08.10.2012 placed on record at Annexure P-2. Counsel for the petitioner has not been able to advert to any other provision/policy which would cover the claim of the petitioner seeking extension in service while serving as Senior Assistant beyond the age of 60 years.

For the reasons recorded above, there is no merit in the petition and the same is accordingly dismissed.
