Janki @ Poonam v. The State Of Madhya Pradesh

1 M.Cr.C. No. 8100/2016 Janki alias Poonam Vs. State of M.P.

26.07.2016 Shri P.S. Bhadoriya, counsel for the applicant.

Shri Prabal Singh Solanki, Public Prosecutor for the State/ respondent.

Heard the learned counsel for the applicant.

This is the repeat application of the applicant, whereas previous application was dismissed on 16.06.2016 being withdrawn.

The applicant has an apprehension of her arrest relating to Crime No. 104/2016 registered at Police Station Dehat District Bhind for the offence punishable under Sections 419, 420, 467, 468 of IPC and Section 3/4 of Examination Act.

After considering the submissions made by the learned counsel for the parties and looking to the facts and circumstances of the case, without expressing any view on the merits of the case, it appears that there is a grave case of forgery lodged against the applicant that she appeared in the examination instead of her younger sister Renu. Manipulation was done on the admission card. It is true that initially when case was registered for offence under sections 419 and 420 of ipc, the applicant was released on bail by the Sessions Court.

However, at present, when it is a case of forgery and the Investigation Officer has mentioned that the presence of the applicant is required during investigation, it is not a good case in which the applicant may be released on anticipatory bail.

Consequently, the application under Section 438 of the Cr.P.C.

filed by the applicant Janki alias Poonam is hereby dismissed.
