Col. Naginder Singh v. Union Of India & Ors.

20.02.2015 Issue notice. Learned counsel for the respondents accepts notice. This petition is taken up for disposal with the consent of the learned counsel for the parties. Petitioners claim is that he was deployed with the Border Organisation in highly volatile insurgency infested areas of the North-East. For their deployment, they were required to be paid special compensatory allowance which has been denied to him. It is contended by the learned counsel for the petitioner that this issue is no longer res-integra as the matter already stands settled by the co-ordinate Bench of this Tribunal vide its order dated 19.04.2011 passed in OA No.144 of 2011 titled as Brig. A.K.Bhutani & others Vs. U.O.I and others. Appeal against this order has also been dismissed by the apex court on merit as well as on limitation on 16.01.2012. In view of the above, we allow the petition and direct the respondents to grant the Special Compensatory allowance in terms of the directions passed by the co-ordinate Bench of this Tribunal in OA No.144 of 2011 as stated above in its letter and spirit. The petition is disposed off accordingly. No order as to costs. ( SUNIL HALI ) MEMBER ( J.N.BURMA ) MEMBER New Delhi
