I.I.M.T. Nagar, Mavana Road, Ganganagar, Meerut-250001 (U.P.) Facts arising from the Complaint: Mr. Jai Narain Sharma had filed a RTI application with the PIO, I.I.M.T. Professional College, Mavana Road, Ganganagar, Meerut on 27/05/2009 asking for certain information. Since no reply was received within the mandated time of 30 days, he had filed a complaint under Section 18 to the Commission. Mr. Neeraj Mittal, finance controller of I.I.M.T. Engineering College, Mavana Road, Ganganagar Meerut vide letter dated 23/07/2009, stated that, Honble Commission has vide its order dated December 3rd, 2007 ( In the matter of Shahid Kapoor Vs IIMT College of Medical Sciences, Appeal No. 1255/ICPB/2007) has opined that self financed educational institution is not a Public Authority. No information can be obtained under RTI Act in respect of same. Our institution being self financed private college is not covered under the definition of (Public Authority) as given in section 2 (h) of the Right to Information Act 2005 and thereof no information can be obtained from us under the provisions of RTI Act. Decision: It appears from the above facts, that the college is not a public authority. The Complaint is dismissed. Notice of this decision be given free of cost to the parties.
