Pradeep Ram v. State Of Jharkhand Opposite Party.

IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 1335 of 2016

Pradeep Ram ..... … Petitioner Versus

The State of Jharkhand .…. … Opposite Party --------

    CORAM : HON’BLE MR. JUSTICE H. C. MISHRA ------

For the Petitioner : Mr. Deepak Kumar, Advocate For the State : A.P.P.

    --------

3/ 10.03.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offences under Sections 414, 384, 386, 387, 120-B of the Indian Penal Code, Sections 25(1-B)(a), 26, 35 of the Arms Act and Section 17(i)()ii) of the C.L.A. Act, in connection with Tandwa P.S. Case No. 2 of 2016 corresponding to G.R. No. 45 of 2016.

There is recovery of Rs. 57,57,710/- from the house of the petitioner in cash, which is alleged to be the money realized in levy.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and the petitioner is a contractor and also engaged in transportation business. It is submitted that the petitioner is a man of means and he has business transactions in crores of rupees even through Bank. In support of his contention learned counsel has brought on record the Bank statement of the petitioner to show the money transaction out of business. It is also submitted that just prior to the occurrence, the petitioner had received Rs. 58.00 lacs in connection with his business transaction and part of the same money has been recovered by the police. Learned counsel has accordingly, prayed for bail.

Learned counsel for the State has opposed the prayer for bail submitting that the witnesses have supported the prosecution case of recovery from the house of the petitioner. It is, however, admitted that all the witnesses are the members of the police party and the seizure list witnesses.

In the facts of this case, I am inclined to enlarge the petitioner, Pradeep Ram, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Tandwa P.S. Case No. 2 of 2016 corresponding to G.R. No. 45 of 2016.
