Factual and Procedural Background

Pursuant to Advertisement No. 27 of 2012, the appellant appeared in the Combined Junior Engineer Recruitment Examination 2012 and was declared successful in the result published on 29.10.2012. The essential qualification required was a Diploma in Mechanical Engineering from a recognized university or institute, and original certificates were to be produced at the time of interview. The appellant claimed to have passed Part I and Part II of the Institution of Mechanical Engineers (India) examinations in December 2004. However, the respondents found this diploma not to be a valid certificate under the terms of the advertisement. Additionally, the appellant did not produce the original certificate at the interview but submitted a representation stating that the institute would issue the original certificate after 15 days. The recruitment process had already been concluded and appointments made by the time of this appeal.

Legal Issues Presented

  1. Whether the diploma obtained by the appellant from the Institution of Mechanical Engineers (India) qualifies as a valid educational qualification under Advertisement No. 27 of 2012 for the post of Junior Engineer.
  2. Whether the appellant fulfilled the mandatory requirement of producing original certificates at the time of the interview.
  3. Whether the appeal could be entertained after the recruitment process and appointments had been concluded.

Arguments of the Parties

Appellant's Arguments

  • The appellant claimed to have passed the relevant parts of the Institution of Mechanical Engineers (India) examinations in December 2004, which he argued should be recognized as equivalent to a Diploma in Mechanical Engineering.
  • The appellant relied on a Notification dated 24.11.2006 from the Ministry of Human Resource Development, which recognized the Institution of Mechanical Engineers (India) diploma as equivalent to a state polytechnic diploma, subject to certain conditions.
  • The appellant contended that since he was registered in 2001 and appeared in the examination in 2004, he should be covered by the recognition granted by the notification.
  • He submitted a representation explaining the non-production of the original certificate at the interview, stating that the institute had assured issuance of the original certificate after 15 days.

Respondents' Arguments

  • The respondents held that the diploma from the Institution of Mechanical Engineers (India) was not a valid certificate as per the terms of Advertisement No. 27 of 2012.
  • They pointed out that the Government of India had withdrawn recognition of the diploma courses in 2002, and although recognition was restored in 2006, it did not cover candidates registered prior to 10.06.2002 beyond certain deadlines which the appellant did not meet.
  • The appellant failed to produce the original certificate at the time of the interview, which was a mandatory requirement.

Table of Precedents Cited

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The court analyzed the appellant’s educational qualification in light of the advertisement and the Government of India’s notification dated 24.11.2006. It noted that the appellant’s diploma was not recognized under the advertisement since the recognition withdrawn in 2002 was only reinstated with effect from 16.10.2006 and did not cover students registered prior to 10.06.2002 beyond the December 2006 examination. Since the appellant was registered in 2001 and appeared in 2004, he was not covered by the reinstated recognition. Furthermore, the appellant failed to produce his original certificate at the interview, which was a mandatory condition. The court also considered the procedural posture, noting that the recruitment process had concluded and appointments made, rendering the matter stale. Consequently, the court found no reason to grant relief to the appellant and dismissed the appeal.

Holding and Implications

The appeal was dismissed.

The direct effect of this decision is that the appellant’s claim to be appointed as Junior Engineer based on his diploma from the Institution of Mechanical Engineers (India) was rejected. The recruitment process and appointments already finalized were upheld. The opinion does not establish any new legal precedent or broader implications beyond the parties involved.

IN THE HIGH COURT OF JHARKHAND AT RANCHI L.P. A. No. 400 of 2015 Alok Peter Toppo, S/o Telesfor Toppo, R/o Qrs. No. A15, Sector3, P.O&P.SDhurwa, DistrictRanchi ... Appellant Versus

    1. The State of Jharkhand

    2. The Chairman, Jharkhand Public Service Commission, Ranchi

    3. The Secretary, Jharkhand Public Service Commission, Ranchi

    4. The Controller of Examination, Jharkhand Public Service Commission, Ranchi ... Respondents For the Appellant: Mr. S.K.Sinha, Advocate For the JPSC: Mr. Sanjay Piprawall, Advocate CORAM: HONBLE MR. JUSTICE VIRENDER SINGH, CHIEF JUSTICE HON'BLE MR. JUSTICE SHREE CHANDRASHEKHAR 07/Dated: 8 th March, 2016 Per Virender Singh, C.J. Pursuant to Advertisement No.27 of 2012 issued on 31.03.2012, the petitioner appeared in the Combined Junior Engineer Recruitment Examination2012 and he was declared successful in the result published on 29.10.2012. The essential educational qualification for appointment on the post of Junior Engineer was Diploma in Mechanical Engineering from a recognized university or a recognized institute. The candidates were required to produce the original certificates at the time of interview. The petitioner claims to have passed PartI and PartII of the Institution of Mechanical Engineers (India) examinations in the Diploma in Mechanical Engineering Branch in December, 2004. The said Diploma in Mechanical Engineering has been found by the respondents not a valid certificate in terms of Advertisement No. 27 of 2012. The learned counsel for the petitioner referring to Notification dated 24.11.2006 issued by the Ministry of Human Resource Development, Department of Higher Education, Government of India submits that the Degree/Diploma courses of the Institution of Mechanical Engineers (India) is the recognized degree equivalent to Diploma in Mechanical Engineering from a State Polytechnic however, the said notification discloses that in the year, 2002, the recognition of the courses was withdrawn by the Government of India and subsequently, the said decision was reviewed, granting recognition of the courses run by Institute of Mechanical Engineers (Mumbai) with effect from 16.10.2006. It was further provided that the students, who were registered prior to 10.06.2002 for PartI and PartII of Technician Engineers (Diploma Level) and Section A and B of Associate Partnership Course/Degree Level would be allowed to complete the course with prerevised syllabus till the next scheduled examination, which was to be held in December, 2006. Admittedly, the petitioner was registered in the year, 2001 and he appeared in the examination in Diploma in Mechanical Engineering Branch in December, 2004 and a provisional certificate was issued on 21.11.2005. It is thus apparent that the petitioner is not covered under Notification dated 24.11.2006 issued by the Government of India. Moreover, at the time of interview, the petitioner did not produce his original certificate and in this regard he submitted representation on 20.12.2012 stating that the institute has assured him that the original certificate would be issued after 15 days. Viewed thus, the petitioner does not fulfill the mandatory requirements mentioned in Advertisement No. 27 of 2012. What appears to us is that the instant matter by efflux of time turns out to be stale one for the reason that the processes for appointment on the post of Junior Engineer, Mechanical have already been concluded and appointments have also been made. Viewed thus, we do not find any reason to show indulgence in the instant appeal at this stage. Resultantly, the appeal on hand stands dismissed. (Virender Singh, C.J.) (Shree Chandrashekhar, J.)
