K. Vinod Chandran, J.:— The petitioner is an Anganwadi Worker, who contested the Local Body elections and became member of the Committees. The petitioner was before this Court since she was sought to be terminated from her post of Anganwadi Worker, for reason of her having contested and won the elections and remaining the member of the Local Body. The petitioner had approached this Court and the petitioner was continued on the basis of the interim orders.

Text in vernacular
3. Going by the aforesaid Government Order, even those persons, who had won the elections in 2010, despite there being a disqualification in the Panchayat Raj Act, 1994, was allowed to resume dues. In any event, by the Act 34 of 2014, the disqualification in Section 30 of the Panchayat Raj Act has been taken away. As per the Government Order, those persons who are continuing merely as members, could be permitted to attend the Local Body meetings by taking casual leave. As for persons, who are elected as office bearers, for that term they would be excluded from the post of Anganwadi Workers and they would not get any honorarium for that period. The petitioner shall be considered in the light of the said Government Order and the continuance of the petitioner shall also be regularised since the Government Order permits such continuance in employment as Anganwadi Worker, if she is merely Committee member in the Local Bodies.
4. In any event, the Local Bodies constituted in the year 2011 have completed their term and new elections have been conducted and new committees are in office. In such circumstance, if the petitioner is elected for a further term, she also shall be regulated by the aforesaid Government Order and the provisions of the Panchayat Raj Act unless amended or modified.
5. The writ petitions would stand disposed of with the above observations. No costs.
