Following Srimanthi Ruja Yarlagadda Durga Prasada Nayadu v. Srimathu Raja Yarlagadda Mallikarjuna Prasada Nayadu(1) which we cannot regard as overruled by the reference to it obiter in Tuljaram Row v. Alagappa Chettiar we hold that the appeal does not lie and dismiss it with costs.
