    Jaganadha Sahu v. Rama Sahu

    1. Following the decision in Appeal No. 124 of 1911 [Viswanatha Santhasingarao v. Ramachandra Mardraja Deo(10)], we hold that there was a sufficient acknowledgment of liability under the promissory note by the endorsement, dated 7th February, 1909 (signed by the 1st defendant), to entitle the plaintiff to take advantage of Section 19 of the Limitation Act.

    2. We, therefore, set aside the decree of the learned District Judge and remand the case for fresh disposal of the Appeal Suit No. 317 for 1912 filed in his Court.

    3. Costs of this second appeal will abide.
