Court's Reasoning and Analysis

The court issues interim directions to ensure that the investigation into the identified unnatural deaths proceeds with an appropriate level of supervision and independence. It directs that the investigation be conducted by an officer not below the rank of Superintendent of Police, and further specifies that if investigation has been conducted by a lower-ranking officer, the Superintendent of Police must give a “fresh look” and continue the investigation without being constrained by subordinate officers’ earlier views if circumstances warrant.

In addition, by interim order, the court directs the States of Rajasthan and Haryana to create a Special Dowry Cell at the State level for investigation of dowry deaths through specialized investigative units. The court also provides for associating one or two leading women social workers—named by the Ministry dealing with Social Welfare and women’s problems—with such dowry cells.

Holding and Implications

INTERIM DIRECTIONS ISSUED: The States of Rajasthan and Haryana and concerned police officials are directed to proceed with the investigation into the unnatural deaths of Mrs Kantha and Mrs Prasani Devi, with the investigation to be conducted by an officer not below the rank of Superintendent of Police, including a fresh review by the Superintendent where applicable. The States are further directed to create a Special Dowry Cell at the State level to investigate dowry deaths, with possible association of nominated women social workers. The matter is to be listed after summer vacation.

The direct effect is to strengthen and re-orient the ongoing investigations through higher-ranking oversight and to require institutional mechanisms (Special Dowry Cells and specialized units) for investigating dowry deaths at the State level. The order is interim in nature, and the opinion does not indicate any broader precedential implications beyond these directions.
