Smart Summary

Factual and Procedural Background

This matter arose from a special leave petition concerning elections of the North Eastern Railway Employees Union, a trade union registered under the Trade Unions Act, 1926. The High Court had issued a direction designating the General Manager, North Eastern Railway (Respondent 6) as the authority to hold the union elections. Notice in the special leave petition was confined to whether this designation should be substituted with the Registrar of Trade Unions, Uttar Pradesh.

When the case was taken up, Respondent 6 sought an adjournment to file a counter-affidavit; the Court declined the request, stating there was no necessity for such an affidavit. The Court heard counsel for the appellants and contesting Respondents 2, 3, and 4.

Legal Issues Presented

  1. Whether the High Court’s direction appointing the General Manager, North Eastern Railway as the authority to hold elections of the North Eastern Railway Employees Union should be substituted by directing that the Registrar of Trade Unions, Uttar Pradesh supervise/hold the elections.

Arguments of the Parties

Court's Reasoning and Analysis

The Court identified the Registrar of Trade Unions as the authority charged with administering the provisions of the Trade Unions Act. On that basis, it concluded that the High Court was “obviously in error” in designating the General Manager, North Eastern Railway as the authority to hold the elections of the trade union. Consequently, the Court modified the High Court’s direction to align the election-supervision function with the statutory administrative authority, namely the Registrar (or an officer designated by the Registrar).

Procedurally, the Court refused Respondent 6’s request for adjournment to file a counter-affidavit because it found no necessity for such an affidavit in resolving the confined question.

Holding and Implications

SPECIAL LEAVE GRANTED; HIGH COURT JUDGMENT MODIFIED; APPEAL DISPOSED OF.

The High Court’s direction was modified so that the union elections are to be held under the supervision of the Registrar of Trade Unions, Uttar Pradesh, or an officer designated by the Registrar, instead of the General Manager, North Eastern Railway. The appeal was disposed of with no order as to costs. The opinion does not indicate that any new precedent or broader legal implications were set beyond this modification.

    Order

    1. In this special leave petition notice was confined to the question as to whether the direction made by the High Court designating the General Manager, North Eastern Railway as the authority to hold elections of the North Eastern Railway Employees Union, a trade union registered under the Trade Unions Act, 1926, should be substituted by the Registrar of Trade Unions, Uttar Pradesh. In response to the notice, the respondents have appeared and when the case was taken up, a prayer was made on behalf of Respondent 6, General Manager, North Eastern Railway for adjournment to enable him to file a counter-affidavit. We decline the prayer as we do not see any necessity for any such affidavit by him.

    2. We have heard learned counsel for the appellants as well as contesting Respondents 2, 3 and 4. The Registrar of Trade Unions is the authority charged with the duty of administering the provisions of the Trade Unions Act. The High Court was obviously in error in designating the General Manager, North Eastern Railway as the authority to hold elections of the Trade Union. We accordingly grant special leave, modify the direction made by the High Court and direct instead that the elections will be held under the supervision of the Registrar of Trade Unions or by an officer designated by him for that purpose. The judgment of the High Court stands modified to the extent indicated.

    3. The appeal is disposed of with no order as to costs.
