    A. Annamalai v. General Manager, Tamil Nadu State Transport Corporation, Salem Division Ii, Ltd., Dharmapuri

Markandey Katju, C.J:— This writ appeal has been filed against the impugned order of the learned Single Judge, dated 9 November, 2004.

    2. The appellant is a bus conductor and he challenged the transfer order on the ground that it is in the middle of the academic year and hence transfer would affect his children's education. We are afraid we cannot interfere on that ground in the writ appeal.

    3. A writ of certiorari lies when there is an error of law apparent on the face of the record. In this case no error of law has been shown to us. A writ does not lie on the ground of sympathy or compassion. There are well settled limitations on the exercise of writ jurisdiction.

    4. Transfer is an incidence of service and hence we cannot interfere. The writ appeal is, therefore, dismissed. Consequently, Writ Appeal Miscellaneous Petition No. 7879 of 2004 is also dismissed.
