Judicial Opinion Summary — Subba Rao, J.

Factual and Procedural Background

The opinion records that a legal question had been referred to a Full Bench of this Court. Subsequently, the Supreme Court addressed the same question in the case of Ramaswami Iyengar v. Kailasa Thevar (AIR 1951 SC 189) and issued a holding relevant to that referral. The Supreme Court reversed the earlier judgment of this Court which had prompted the Full Bench reference. Following the Supreme Court's decision, the present opinion concludes that the question referred to the Full Bench should be answered in the negative. The appeals are to be posted before a Bench for argument on other questions that were raised.

Legal Issues Presented

  1. Whether, under the plain provisions of the Agriculturists Relief Act, a decree for a reduced amount can be passed against an agriculturist (judgment debtor who is a mortgagor) even if the same relief is not given to his co-debtors who do not fulfil the description of an agriculturist.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

Precedent Rule or Principle Cited For Application by the Court
Ramaswami Iyengar v. Kailasa Thevar, AIR 1951 SC 189 (p. 193) The Supreme Court held that where the judgment debtors are mortgagors and fall within the Agriculturists Relief Act, there could be no objection to a decree for a reduced amount being passed against an agriculturist debtor even though similar relief is not extended to his co-debtors who are not agriculturists. The court relied upon this Supreme Court decision to conclude that the question previously referred to the Full Bench should be answered in the negative; the Supreme Court's reversal of this Court's earlier judgment dictated the outcome.

Court's Reasoning and Analysis

The reasoning in the opinion is concise and centers on the effect of the Supreme Court's decision in Ramaswami Iyengar v. Kailasa Thevar. The steps of analysis set out in the text are:

  1. The Court notes that after the question was referred to the Full Bench, the Supreme Court addressed the identical question and laid down a ruling regarding application of the Agriculturists Relief Act where judgment debtors are mortgagors.
  2. The opinion reproduces the Supreme Court's holding that, given the plain provisions of the Agriculturists Relief Act, a decree for a reduced amount could be passed against an agriculturist debtor even if similar relief is not available to co-debtors who are non‑agriculturists.
  3. Because the Supreme Court reversed the earlier judgment of this Court (the decision that prompted the Full Bench reference), the Court concludes that the question referred to the Full Bench must be answered in the negative—i.e., in conformity with the Supreme Court's ruling.
  4. The opinion then directs that the appeals be posted before the Bench for arguments on other questions raised, indicating that this determination resolves only the referred question in light of the higher court's authority.

Holding and Implications

Holding: The question referred to the Full Bench is answered in the negative.

Implications:

  • The Court follows the Supreme Court's ruling in Ramaswami Iyengar v. Kailasa Thevar; as the Supreme Court reversed this Court's earlier judgment, the referred question must be decided against the position previously taken by this Court.
  • The immediate practical consequence is that the referred question is resolved in accordance with the Supreme Court's interpretation of the Agriculturists Relief Act as applied to agriculturist debtors who are mortgagors.
  • The appeals will proceed to be posted before the Bench for argument on other issues raised; the opinion does not elaborate any broader doctrinal consequences beyond applying the Supreme Court's decision.

Subba Rao, J.:— Subsequent to the reference to the Full Bench the Supreme Court had to deal with the same question. They held in — ‘Ramaswami Iyengar v. Kailasa Thevar’, AIR 1951 SC 189 at p. 193 (C) as follows:

“Here the judgment debtors are the mortgagors themselves and according to the plain provisions of the Agriculturists Relief Act, there could not be any objections to a decree for reduced amount being passed against an agriculturist debtor, while the same relief is not given to his debtors who do not fulfil that description.”

    2. It may be mentioned that the Supreme Court reversed the judgment of this Court which was the occasion for referring the question to a Full Bench. It follows that the question referred to the Full Bench should be answered in the negative.

    3. The appeals will be posted before the Bench for arguments on other questions raised.
