THE CHBHATTISGARH SPECIAL POLICE ESTABLISHMENT (REPEAL)
: ADHINIYAM, 2003
An Act to repeal the Chhattisgarh Special Police Establishment Act, 1947 in view of the existing provision to appoint a separate agency for similar functions under the Chhattisgarh Lok Aayog Adhiniyam; 2002. .
Beit cnacted by the Chhattisgarh Legislative Assembly in the Fifty-fourth year of the Republic ofIndia as follows :—
L. This Act may be called the Chhattisgarh Special Police Establishment (Repcal) ~ Shors title and Com- Act, 2003. S mencement.
Q) LIt shallv come into force from the date of its publication in the Gazette.
2 M The Chhattisgarh Special Police Establishment Act, 1947 (No. 17 of 1947) is Repeal and Sflvkflp hereby repealed and the Special Police Establishment created under the said Act is dissolved. .
) All assets and liabilities of the aforesaid Special Potice Establishment shall be vested in the State Government which shall have powers 10 take possession of, recover and otherwise deal with such assets and discharge such liabilities;
3) The State Government may, by order entrust matters pending in the aforesaid Special Police Establishment to any other organization which shall deal with such matters there after : .
. Provided that those matters referred to the aforesaid Special Potice Establishment before its dissolution by the Chhattisgarh Lok Aayog shall stand transferred to the agency appointed by the State Government under section 13 {5) of the Chhattisgarh Lok Aayog Adhiniyam, 2002 (No. 30 of 2002). . @) All actions taken by the aforesaid Special Police Establishment before its disso- lution shall be deemed to have been taken by the agency or organization as the case may be referred to in sub-sections (3) and in any proceedings before any court in which the aforesaid Special Police Establishment is a party, it shall be deemed to be substituted by the agency or organization aforementioned. as the case may be.
