Extra ordinary, part lv-B d;ted tlre 16' Febmary, 20ll under rhe Govemmenr Notit'icarion. Agriculture and cooperation Departmenr No. GHI(H- I5-2012-csB- l2-2009-2596-cH. dated rhe l6n February,20l2 inviting objection and suggestion fron all persoru likely ro be afl-ected rhereby within a period of thirty days from the date ofpublicadon ofthe said notificarion in the OIJicial Gazette. AND WHER-EAS. objecrions or suggestions received "fiom the public on the said draft have been considered by the Govemmenr.
Now, THEREFORE, in exercise of the powers conferred by sub section (3) of rhe section 168 of the Gujarat Co-operarive Socieries Act, l96l (Guj. X ol 1962), the Government of Gujarat hgreby makes the follo*ing rules funher ro amend rhe Gujarat co-operarive Societies Rules, l965,na:rely :-
l. These rules may be called rhe Gujarar co-operarive Societies (ln amendment) Rules.

2. In the Guj arat co-operative Socieries Rules, 1965, (hereinafter referred to as the said rules'), in rule 5. in suFrulc (2)-
(i) after clause (b). the following clause shall be Inserted namely:-
"(bb) for enrolment of the depositors and the borrowers as members or nominated members falling under the co-operative credit structure as required under sub- section
(4) of section 22. lV-B-Er.-l7i-l l7i-l

(ii) in clause (c). the lbllorving proviso shall be addeti. nam.'ly:-
'Provided that in case of a co-operative society.. lilhng under the definition ot'co-operative credil slructure shall nra.lic a provision under its bre-lass to determine. lrir'r ume lo tinrr' such area of its operation as it deems fit":
(ii i) after clause (e). the folloruing cliluse shall be irsened. natnely':-
"(ee) provisions regarding suhscribing lini
and half percent of loan taken b) lhe bl)rrr)wer".
3. In the said rules, rule 6 shall be renumbered as sub-rule (l ) ol that rulc .:rid after sub-rule r Ir as so renumbered, the follorving sub-rule shall be inserted. namely:-
"(2) The Registrar shall dispose of the application within sixtl dals ti(\rn the dale olth:
receipt of the application".
4. In the said rules, aticr mle I i. the loliowing nrles shall be inscned, nameh : -

5. ln the said rules, after rule 14. the follorving rule shall be inserted, namely:-
" I4.A. Suspension of rig}t tc vote.- A person who has committed a dctault and remains defaulter in making repalment of loan or intcresl thereon lbr a priod of on year liont tlic due date of repayment of such loan or interest or installment shall not be entitied to exercise \r)trng nghts of a member o1' such society rill all such repa)'ments ate made.'.
6. ln the said nrles, in rule 15, afler the words "which ierm shall irrt'lude", the rvords'gmupof individuals rvhether incorporated or not and u'hether estahlished or not bi'or under any law". shali be inserted.
7. ln rhe sard rules, rule 16 shall bc renunrbered as sub-nrle( I ! of that rule and atier sutrrule ( l) as so renumbered, the following sub-nrle shall be insertcd, namely:-
" (2) In the case of sociedes rn the co-operative crEdit slructure. the State Govemment shall not subscribe for more rhan t\ enty-five percent, of the lotal sh: c capital of the society and the Stale Gol'emrnenl or the society shall have the option to rcduce the share capital contributed by the Srale Govcmment."-
8.ln rhe said rules. rulc 3l shall be renumbered as sub.rule (l) of that rule and after sub-mle (l1as so renumbcred. the tbllowing sutr-rule shall be insertcd. namely:-
"(2) '[he provisions of sub-nr]e (i ) shall not apply to lhe societies lhlling in rhe co-operative credit structure"
9. ln the said rules, rn rule 12. in sub-rule (l), affer clause- (a). the tbllowing clause shall be insened. namely:-
"(aa) he is not a dct'aulter in respect of a loan or interest thereon as specified in sub-secdon (2)ol'section 17 ol'thc n ct. or"

10. In the said rules, afier rulc 33. the lbllorving rule shall be Inserlui. nameil,:-

(d) Subject to the provisiorrs of the Act and r,:le-s. Lhe rnatters of appointment ol'auditors. rheir compenmtion and intcmal checks and control systems.
(e) To frame borrowirg policy'as per rhe requiremcnr oisociety and its mcmbers subjecr tp the conditioti that borror.ving by the society slrall he froin the linaucial rnstirutions rcgulared b;; the Resen,g lJank of India.'.
il. In thc said mles, in rule 37A. aftcr :;ub-iule (4t, the ibllo$ing sub- rulc shall be adieo. namely:-
"(5) mcmber ol t}e societl' not heing member ol rhe comminee removed ny the Registrar under section 8 i of the Act"
12. In the said rules, rule 38 shall be rcnumbered a.s sub-rule ( l) of thal rule and -
(i) in sub-rule ( I .y as so renumbercd. befrrre thc ruords "A person shall be qualified',: the figure, brackets and words,, 'Subject to the provisions of :rub-rule (2)', shall be inserted. (ir) after the said sub-rule (l), rhc foilowing sub-rule shall be added, namcly..:-
'(2) Notwithstanding anything contained in sub-rule (l), in the case ol'Cenrral Co-operative Banks and the state Go-operative Bank, rhc audit shall be conducted only by the chartered Accountants from rhe panel approved by the National Bank".
