Steel and Steel Products (Quality Control) Order, 2019

In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in the supersession of the Steel and Steel Products (Quality Control) Order, 2018, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 3966(E), dated the 13^th August, 2018, except as respects things done or omitted to be done before such supersession, the Central Government being of the opinion that it is necessary or expedient so to do in the public interest and after consulting the Bureau, hereby makes the following order, namely:

Section 1. Short title, commencement and application

(1) This order may be called the Steel and Steel Products (Quality Control) Order, 2019.

(2) It shall come into force on the date of its publication in the Official Gazette.

(3) It shall apply to steel and steel products specified in column (3) of Table 1 and goods and articles specified in column (2) of Table 2 except steel and steel products for export which conform to any other specification required by a foreign buyer.

Section 2. Conformity to standards and essential requirements

(a) Every steel and steel product specified in column (3) of Table 1 shall conform to the corresponding Indian standards specified in column (2) of the said Table with effect from the dates specified in column (5) thereof.

(b) Stainless steel pipes and tubes shall be made from the stainless steel products specified in column (3) of Table 1 conforming to Indian Standards specified in column (2) of said Table, bearing Standard Mark and shall be accompanied with the test certificate of input material.

(c) Goods specified in column (2) of Table 2 shall conform to the corresponding essential requirement(s) specified in column (3) of the said Table under a Certificate of Conformity from the Bureau as per Scheme-V of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

Section 3. Compulsory use of Standard Mark

Every steel and steel products specified in column (3) of Table 1 shall bear the Standard Mark under a licence from the Bureau as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

Section 4. Certification and enforcement authority

The Bureau shall be the certifying and enforcing authority in respect of the steel and steel products, goods and articles specified in this order.

Section 5. Penalty for contravention

Any person who contravenes any of the provisions of this order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.

Section 6. Date of effect of amendment or revision in Indian Standards

This order shall apply to any amendment or revision made by the Bureau to any of the Indian Standards specified in Table 1 with effect from the date notified by the Bureau in this behalf.
